Gimli Harbour
Moorage Rules and Regulations [Condensed from Harbour Manual] 2010

All persons using
Gimli Harbour and its facilities, their visitors, family members, servants, invitees do
so at their own risk.

All vessels moored
and or launched at Gimli harbour shall be at the owners’ risk.
3. Written
notice will be given by September 15th 2011 if the vessel owner wishes to renew moorage for
the following season.
Note:A
$200.00 deposit of the seasonal fee will be paid on application but will be paid in full by
May 1, 2012 and be accompanied by a properly completed
registration form to
confirmseasonalregistration. Down payment is non-refundable when cancellation is made after
December 31, 2011. Slip fees are non-refundable when cancellation in made after May 1,
2012. See rule #15

Boats
will not be
permitted use of the Harbour slips, unless the slip is prepaid and accompanied by a
completed registration form

All Harbour users
are subject to daily, monthly, or seasonal rates as determined by
GHA.

Eachowner is
responsible for the safe mooring of their vessel, and shall furnish and maintain their
own safe and adequate lines and chaffing gear. Fenders etc. should be attached to the
vessel, and no bumpers shall be attached to the docks except by prior permission from
the Harbour Authority. Care should be taken not to foul any other berth or access with
mooring lines. All bumpers will be removed at season’s end.

Boat owners are
required to check their vessels regularly, especially after heavy rain or winds. Canvas
covers, dock lines and bilge pumping are the owner’s responsibility. Any vessel that
poses a threat to other vessels due to negligence will be attended to if needed and a
service charge imposed at the owners’ expense.

All
operators of vessels approaching, using, or leaving the harbour facilities shall do so
in a cautious and seamanlike manner, so as NOTto roll up wash or wake or do damage to other
craft or Harbour facility equipment. Speed limit of 9 km
notto be exceeded.

In
the interests of sanitation and environmental concerns toilets shall
notbe
discharged into the harbour. The harbour pump out is provided free of charge for the
evacuation of holding tanks. Violators will be asked to leave the harbour and forfeit
their berth standing. All vessels must conform to Federal Boating Standards for septic
systems and are subject to inspection. Gimli Harbour is as determined under the Canada
Shipping Act, a zero discharge Harbour. All vessels will conform to GHA policy of
vessels not being capable of discharging sewage into Gimli Harbour. A periodic
inspection for vessel compliance to this policy will be done by a GHA
approved/recognized inspector with the vessel owner present. Proof and verification of
vessel being unable to discharge sewage is the responsibility of the vessel owner.
Vessel owners not complying with this policy or inspection will be refused use of the
Gimli Harbour and the vessel will be removed and may only use the Gimli Harbour when
the vessel can be proven to conform while in the Gimli
Harbour.

A boat owner registered as user of a designated slip will be the
sole user of that slip and will not lend, rent or permit that slip to be used by anyone
else without prior approval and arrangements through the
Gimli Harbour Master.

Any visiting vessel operator coming into this harbour shall not secure to any
dock without registering in a timely manner at the Harbour office or to an authorized
harbour staff person. A temporary visitors / emergency slip are available on the south
Pan Am pier floating dock.

While efforts will
be made to contact vessel owners, the Gimli Harbour Authority reserves the right at any
time to arrange the position of any vessel moored in the harbour facility should the
need arise, without previous arrangement to the owner of such vessel. The owner hereby
appoints the company their agent for this purpose.

Vessels moored at
the harbour facility shall not be used for charter without prior approval of the Gimli
Harbour Authority.

No
reflective type heaters, flame type, or oil burner is to be operated unless the owner
or someone designated by him/her is in full attendance. Further; no barbeques or open
fires are permitted on Harbour property unless authorized and by permit from
GHA
-
All vessels will be clearly marked with the name, license or registration number
as required by law. All unlicensed vessels will have a Harbour Registration sticker
affixed to it in a conspicuous location, as determined by the Harbour
Authority.

The storage of
inflammable liquids, oily rags, etc is prohibited on harbour docks or elsewhere in the
harbour area. Owners can carry out minor maintenance or repairs at the mooring. No
litter shall be thrown overboard or left at the premises. Garbage containers and
recycling bins are available for the convenience of users. Disposal of any used
petroleum’s or flammable products are the responsibility of the vessel owners and are
not to be left in the harbour area.

All Gimli Harbour vessels over 10 hp and dinghies will be clearly marked with
the vessels’ name, license or registration number, and dinghies must not be left on the
docks. Dinghies and Jet Ski’s will be left in a communal dock so as not to block
mooring areas. Dinghies over 8’ in length and Jet skis’ and are subject to usual
Harbour fees as determined by Gimli Harbour Authority. Seasonal Jet Ski ports are
available for seasonal fee on the South Pan Am pier.

Automobiles left on
the wharfs for more than 20 minutes will be considered as parked and will be subject to
tow away at owner’s expense. Any vehicle parked within the Gimli Harbour area that is
deemed, by the Harbour Master, to impede or prevent normal daily operations of the
Harbour may be removed, without a warning, by towing and at the owner’s
expense.

An adult must
accompany children under the age of 14 and ensure that children wear a life jacket
while on harbour docks or within mooring areas.

Vessel owners’ their families’ and visitors’ dogsmust be on a leash when around the harbour area,
and will be subject to the animal control by-law of the Town of Gimli. The dog must be
under control at all times so as to not create a nuisance or cause a disturbance to the
users of the harbour.

Vessel owners, their families and or visitors must conduct themselves in a manner
not detrimental to the safety of the harbour or the quiet environment of others. Silent
hours are determined to be between 11 pm to 6 am. (Loud music or disturbing sounds not
permitted at any time.)

Vessels leaving the harbour for any extended periods are requested to leave an
itinerary with the harbour master as a safety precaution.
PLEASE GIVE THIS DUE
CONSIDERATION

The
Gimli Harbour Authority reserves the right to cancel this contract if the owner, his
family, guests or servants breaches any of the provisions of this contract. The owner,
upon cancellation, shall forthwith remove the named vessel from the harbour
area.

The
mooring space allocated to the owner shall NOT be transferred with a change of
ownership of the named vessel. Arrangements for mooring space may be arranged through
the Harbour Master.
-
The
owner shall be responsible for all damage, destruction or loss of Harbour property by
the owners’ vessel, whether under the operation and/or care of the owner or any person
on board with the owners’ consent, both jointly and severally with such person; and
shall pay for same within 30 days of receipt of an account of
same.

Users
of the Gimli Harbour, boaters and non-boaters alike, will not impede the normal use of
any Harbour facilities by other harbour user/visitors. The walkway provided for viewing
the lake and for anglers’ use is to be kept unobstructed.

Any person
purchasing the vessel designated on this contract will not acquire any rights under
this contract.

Subject to rule 9
above, the contract herein shall, for all purposes, be considered to be a storage
contract and fall within the provisions of the warehouseman’s lien
act.
25. Wherever the
word “owner” appears, it shall refer to the person, or company, set forth on the face
thereof, notwithstanding that such person, people or company, is, or are in fact the legal
owners of the vessel.
26. Use of the
Harbour and its’ facilities is meant as acceptance of and compliance to these Rules and
Regulations
GHA POLICY UPDATE #1
When a vessel changes ownership with the seller agreeing to
surrender that slip to the buyer, he may do so under the following conditions:
“3. Notice will be given by April 15th if the vessel owner wishes to renew
moorage for the following season.
Note:Payment of the seasonal fee may be paid on application but will be paid in
full by April 15thto
confirmseasonalregistration. Down payment is non-refundable when cancellation is
made after April 15th.”
Upon the sale of the vessel, with the seller deciding to
retain that slip, and should there be no slip available to the buyer their name, when
requested, may be placed on a registration form for the year following.
Harbour Master instructions:
Seasonal rates are determined as spanning from May
1st to October 31st. Under the circumstance of a vessel being sold and
with the buyer NOT retaining the same slip; a seasonal slip fee rate will be determined
based on a percentage of months remaining in the season. [With 3 months remaining the slip fee
would be estimated at 50% of the seasonal rate remaining and months are whole months for the
determining of this formula.] This only applies if there is an available berth within
the Gimli Harbour.
This policy takes effect for the year commencing
2011.

GHA POLICY UPDATE #2
Gimli Fisher docks, specifically meaning A dock, B dock, the
first two finger docks on the South Dock, and the entire North side of the Fishers’ wharf, are
dedicated to the sole usage of Gimli Harbour Fishers. This has been implemented through Small
Craft Harbours [lease holder] and the Gimli Harbour Authority [lessee].
There are exceptions to this policy;

During the non-fishing season July 14-August 29 Docks A & B may
be offered for casual use by pleasure boaters and at a slip fee set {$175.00+ GST for
2011} by GHA; there is no extension permitted on the set dates.

Any slips that may be provided to pleasure craft use will be
determined by availability and with permission of the GHA solely and by request of the
Gimli Harbour Master.

The outer end finger docks on A & B docks may be used by boaters
as a courtesy slip for a quick Harbour/town visit and is limited to 2 hours maximum,
due to foul weather and or mechanical breakdowns but must vacate the slip when weather
permits or in a timely manner for repair. Overnight stay is not permitted except on
extenuating circumstances and by direction from GHA. All boaters will be required to
report to Gimli Harbour Master.

No variance or changes to these “exceptions of policy” may be made by
Gimli Harbour staff.
